Update on Union County BOE vs. BOCC funding dispute

On April 7, 2015, the North Carolina Court of Appeals issued a decision in the funding dispute matter between the Board of Education and the Board of County Commissioners. The central issue before the Court of Appeals was a first-time interpretation of the law and, while not explicitly stated, the Court read into the law a limitation on the amount of money that could be requested by the Board of Education in a budget dispute trial. Under this interpretation the Board of Education is limited to the amount of its budget request rather than evidence of the school system’s needs.  

However, much has changed since the trial, and both boards are working more cooperatively to meet the legitimate needs of the school system and the children of Union County. This includes the Working Group established to determine funding mechanisms for the needs of the school system.
This collaboration is essential given that the needs of the school system still exist and the decision of Court of Appeals does not in any way reduce those needs.
